This Privacy Policy (the "Policy") serves as a formal notification regarding our practices with respect to the collection, use, processing, storage, and disclosure of information we obtain from you through your use of the What's the moves website, mobile application, and related services (collectively, the "Platform").

By accessing or using the Platform, you acknowledge that you have read and understood this Policy and consent to the data practices described herein. This Policy applies to all users of the Platform, including but not limited to event organizers ("Promoters"), ticket purchasers ("Attendees"), operational staff ("Staff"), Platform administrators ("Admins"), and Hireable Talent.

2. COLLECTION OF INFORMATION

We limit data collection to what is reasonably necessary for the functionality of the Platform, including optional features you elect to use.

2.1. Information You Voluntarily Provide

In the course of using the Platform, specifically during the account registration and ticket purchasing processes, you may be required to provide us with certain personally identifiable information ("Personal Data"). This includes:

  • Identity Data: Your full legal name.
  • Contact Data: Your electronic mail (email) address.
  • Account Classification: Your designation as an Attendee, Promoter, Staff, Admin, or Hireable Talent.
  • Demographic Data (Attendees Only): Your self-identified gender, collected during registration for event analytics and service personalization purposes.
  • Event Content (Promoters Only): If you act as a Promoter, we collect data regarding the events you list, including titles, descriptions, dates, and times.
  • Hireable Talent Profile Data: role, rates (hourly/flat/negotiable), phone number, Instagram handle, age gate (over18/over21), zip code, bio, profile photo, and profile visibility preference.

2.2. Information Collected Automatically

Upon your interaction with the Platform, we automatically record certain transactional and usage data. This includes:

  • Transaction History: Records of tickets purchased, order values, and transaction dates.
  • Attendance Metadata: Timestamps and verification records generated when a ticket is scanned or validated at an event venue.
  • Legal Consent: A timestamped record and boolean flag indicating your affirmative agreement to our Terms of Service.
  • IP Address: Your IP address is recorded at the time of ticket purchase for fraud prevention and security purposes.
  • Marketplace Search Data: zip code, radius filters, and derived distance calculations used to sort nearby Hireable Talent.

3. PURPOSE AND USE OF INFORMATION

We utilize the Personal Data and Usage Data collected for the following specific business purposes:

3.1. Service Provision and Administration

  • To create, maintain, and authenticate your user account;
  • To facilitate the processing of ticket orders and generate digital tickets;
  • To enable Promoters to organize, edit, and manage their event listings;
  • To validate ticket authenticity at the point of entry (scanning).

3.2. Communication

  • To send you transactional confirmations regarding purchases or account updates;
  • To respond to your customer service inquiries or support requests;
  • To notify you of material changes to this Policy or our Terms of Service.

3.3. Legal and Security

  • To enforce our Terms of Service;
  • To prevent fraudulent activity and unauthorized access;
  • To comply with applicable legal obligations and regulatory requirements.

3.4. Internal Administration

To allow authorized Platform administrators to access user account data strictly for moderation, support, and system maintenance purposes. All administrative access to user data is logged and subject to audit.

3.5. Demographic Analytics and Service Personalization

  • To provide Promoters with aggregate demographic analytics about their event attendees for planning and reporting purposes;
  • To personalize the ticket purchasing experience based on your demographic profile.

3.6. Marketplace Operations

To operate the Marketplace, including searching, filtering, ping notifications, and enabling Promoters to view Hireable Talent profiles.

4. DISCLOSURE AND SHARING OF INFORMATION

We do not sell, rent, lease, or trade your Personal Data to third parties for marketing purposes. We share your information only with the following categories of third parties and under the following circumstances:

4.1. Financial Processors (Stripe)

All financial transactions are facilitated by Stripe. When you make a purchase or receive a payout, data is transmitted directly to Stripe. whats the moves does not possess your financial data. By using our Platform, you acknowledge that your data is also subject to Stripe's Privacy Policy.

4.2. Third-Party Service Providers

We engage trusted third-party service providers to perform functions on our behalf. These providers are granted access to your Personal Data only to the extent necessary to perform their contractual duties and are obligated to maintain the confidentiality of such information. Our current categories of service providers include: (a) User authentication and database hosting providers, which store and manage your account data and Platform records; (b) Error monitoring and application performance services, which receive diagnostic data—including user identifiers, session identifiers, and IP addresses—when errors occur, solely for the purpose of debugging and improving Platform reliability; and (c) Email delivery services, which process your email address solely to deliver transactional emails such as account verification, password resets, and Platform notifications.

4.3. Event Promoters and Staff

If you purchase a ticket as an Attendee, we share your Name, Email Address, and Gender with the Promoter organizing the event. This enables Promoters to manage guest lists, verify attendance, provide demographic analytics, and communicate event updates.

Promoters may create linked Staff accounts to assist with event operations. Staff access is strictly limited to viewing Attendee names and ticket validity status for scanning and entry purposes only. Staff accounts are bound by the same data sharing and privacy obligations as Promoters. We are not responsible for the privacy practices of individual Promoters or their Staff.

4.4. Legal Requirements

We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to: (a) comply with a legal obligation, court order, or government request; (b) protect and defend the rights or property of What's the moves; or (c) prevent or investigate possible wrongdoing in connection with the Platform.

4.5. Marketplace Sharing (Promoters ↔ Hireable Talent)

Promoters may view Hireable Talent profile data. Phone numbers and Instagram handles are hidden until a Promoter sends a Ping.

4.6. Notifications

When a Promoter sends a Ping, the Hireable Talent user receives a notification containing the promoter's name and message.

4.7. Administrative Review

Admins may access Hireable Talent profiles for approval, moderation, and deactivation workflows.

4.8. No Hiring or Communication Facilitation

The Platform does not facilitate hiring or communications between Promoters and Hireable Talent beyond discovery and notifications. Any engagement or communications are handled independently by the parties.

5. DATA RETENTION POLICY

We retain your Personal Data only for as long as is necessary to fulfill the purposes set forth in this Policy.

  • Active Accounts: We retain your account data for the duration that your account remains active.
  • Legal Compliance: We may retain specific transactional records for a longer period to the extent necessary to comply with our legal obligations (e.g., tax, accounting, and auditing requirements) or to resolve disputes.
  • Deletion: Upon your request for account deletion, your Personal Data will be removed from our active databases, subject to the retention of data required for the aforementioned legal purposes.
  • Marketplace Notifications & Rate Limits: We store ping notifications and rate-limit records to operate Marketplace functionality.

6. USER RIGHTS AND ACCESS

Depending on your jurisdiction, you may hold certain rights regarding your Personal Data. You have the right to:

  • Access: Request a copy of the Personal Data we hold about you.
  • Rectification: Request correction of any incomplete or inaccurate data we hold about you.
  • Erasure: Request the deletion of your Personal Data and account ("Right to be Forgotten"), subject to legal retention requirements. Attendees, Promoters, and Hireable Talent may self-delete their accounts from the Profile page. Staff users should contact their associated Promoter to request account removal.
  • Opt-Out: Opt-out of receiving non-essential promotional communications, if any.

To exercise any of these rights, please contact us through our support page. We will respond to your request within a reasonable timeframe in accordance with applicable laws.

7. CALIFORNIA PRIVACY RIGHTS (CCPA/CPRA)

If you are a California resident, you have specific rights regarding your personal information under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

  • Right to Know: You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you.
  • Right to Delete: You may request that we delete your personal information, subject to certain exceptions.
  • Right to Opt-Out of Sale: We do not sell personal information. If this changes, we will provide a "Do Not Sell My Personal Information" link.
  • Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.
  • Authorized Agents: You may designate an authorized agent to make requests on your behalf.

We use essential cookies required for the Platform to function (e.g., authentication session cookies). We do not use advertising cookies or third-party tracking pixels.

For analytics purposes, we may use aggregated, anonymized data that does not identify individual users.

9. DATA SECURITY

We implement commercially reasonable technical and organizational security measures designed to protect your Personal Data from accidental loss, unauthorized access, use, alteration, or disclosure. These measures include the use of encryption and secure server infrastructure.

However, you acknowledge that no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

10. TAX DOCUMENTATION AND COMPLIANCE

For Promoters who generate revenue through the Platform, we are obligated by federal tax laws to facilitate the collection of tax identification information if earnings exceed the applicable threshold (currently $600 USD per annum). This process is managed securely through Stripe. Issuance of IRS Form 1099-K is handled directly by Stripe in compliance with federal regulations.

11. AGE RESTRICTION

The Platform is intended solely for users who are at least eighteen (18) years of age. We do not knowingly collect Personal Data from individuals under 18. If we become aware that a user is under 18, we will promptly terminate their account and delete their Personal Data from our systems.

12. AMENDMENTS TO THIS POLICY

We reserve the right to update, modify, or amend this Privacy Policy at any time. Material changes will be communicated by posting the updated Policy on this page with a revised "Last Updated" date. Your continued use of the Platform after any such changes constitutes your acceptance of the new Privacy Policy.

13. DATA BREACH NOTIFICATION

In the event of a security breach that results in unauthorized access to Personal Data, we will notify affected users and relevant authorities as required by applicable law. Notification will be provided through reasonable means and within the timeframes mandated by applicable state and federal regulations.
